Lowe’s. (See Planning Board June 30, 2025.) The Board opened and closed the hearing on the plan to install rooftop solar panels. There were no comments. An approval resolution will likely be on the Board’s September agenda.
Poggioreale Day Care, Crompond Road. (See Planning Board July 14, 2025.) Traffic was once again the issue at the continued public hearing. The applicant assured residents that only right turns in and out of the site would be permitted, even though that would require some clients to detour around local streets. The hearing was closed and the Board will continue to review site plan details.
Toll Brothers. (See Planning Board June 30, 2025.) The applicant submitted a revised drainage plan that addressed the wetlands issue raised at the previous meeting. The Board had no issues with the plan but did want more information about mitigation.
Two other issues were raised during the public hearing: the future of the Field Home and consideration for how the plan will deal with grading on steep slopes.
The Field Home issue revolved around a potential adaptive reuse of the site and Toll Brothers’ objections to a preliminary plan for a boutique hotel prepared by the architect the Town Board hired to explore adaptive reuse options for the building. (Note: The Town Board has not discussed the preliminary hotel plan, nor has it made any decisions regarding the building’s future.) As presented, the plan would require an adjustment to the lot line originally proposed by Toll Brothers and, according to the applicant, the hotel would negatively impact on its townhouses.
The second issue revolved around a letter from the NYS Watershed Inspector’s office in the Attorney General’s office regarding the project’s stormwater plan and disturbance to steep slopes, Councilwoman Siegel, speaking on her own and not as a representative of the Town Board, suggested that the Board refer the stormwater plan (SWPP) to the town’s outside environmental consultant for a more in depth review.
Over the objections of the applicant, the Board voted 2-1 to adjourn the hearing.
AMS. The applicant made a presentation of its traffic mitigation plan for the Route 6/East Main Street intersection – the same presentation it made before the Town Board. A public hearing will be held on September 8.
RIC Battery Storage. (See Planning Board, February 10 2025. In response to the town banning battery storage facilities, the applicant has applied to the Zoning Board for a use variance to allow the installation. Prior to the ZBA hearing scheduled for September 11, the ZBA referred out the application to the Planning Board.
While supportive of BESS facilities, Chairman Fon expressed concern about one at this location given its proximity to the Taconic Parkway and a pedestrian/bike path in the event of a fire and how smoke could become a problem.
The Board will consider a memo the ZBA at its September 8 meeting.
Envirogreen Associates. (See Planning Board February 10, 2025.) The applicant is seeking to amend the approved site plan so that the HVAC equipment can be located in the rear of the building instead of on the roof as noted on the approved site plan. The applicant explained that the change was needed when he belatedly was informed about the size of the equipment the tenant, Dunkin Donuts, needed. While the Board was appreciative of the applicant coming before the Board to ask for permission to make the change (see Kear Street comments below), and said that a;though it preferred roof top installations, it asked the applicant to return with a modified plan for the ground mounted installation.
385 Kear Street. (See Town Board August 4, 2025.) In response to correspondence about the violation of the Board’s approved site plan, Councilman Esposito advised the Board that the owner will be submitting an application to the Board for an amended site plan.
