Creative Living, aka Navajo Fields. (See Town Board, September 8, 2026). This was a referral from the Town Board for a stormwater permit. After Chairman Fon read a memo from the Planning Department noting that the department did not have an approved site plan for the parcel that included the athletic fields, the applicant, C.J. Diven, went through a lengthy power point presentation highlighting documents from 2010 to 2026 that indicated that a site plan with the fields did exist, that the DEC approved the fields, and that an earlier plan included the possibility of artificial turf.
After the presentation, Mr. Fon said that because the Board would need time to go over the voluminous documents, the Board would send a memo to the Town Board stating that it was not ready to comment on the application.
Nantucket Sound/Kear Street. (See Planning Board, October 5, 2026). After a very brief discussion, the Board voted 4-0 to approve an amended site that included the revised mitigation on the Trailway. The only mention of what was in the resolution (which was not made available prior to the meeting) was eliminating the requirement in the draft that the applicant provide the Board with a copy of his contract with the landscape company; the consensus was that as long as the resolution had performance standards, it did not have to see the contract. (Note: An earlier $20,000 performance bond to cover mitigation remains in effect.)
Foothill rezoning (See Planning Board, September 14, 2026). In a 4-0 vote, the Board voted to recommend against the rezoning. The basis for the vote was concerns about steep slopes, wetlands, traffic and the lack of compatibility with the existing neighborhood. After the vote, the applicant asked if the Board would consider seven units in a townhouse-like cluster development; the Board said that a new application would be needed. (Note: The Town Board must approve the use of clustering.)
