Following the Town Board rezoning the 50 acre parcel for a 118 unit active adult community, the applicant made his first appearance before the Planning Board for the start of a more in-depth review and approval of its plans, advising the Board of the different detailed plans it has already submitted e.g., stormwater, grading, landscaping, etc. Given the fact that the applicant had completed a detailed SEQRA review of many of these issues as part of the rezoning application, and in response to questions from Board members, the Planning Department will prepare an outline of specific site plan issues that the Board will want to review.

In addition to approving the site plan for the 118 units, the Board will also consider the application to subdivide the parcel by splitting off 2.46 acres that includes the Field Home.  (Note: the Town Board is currently considering whether to take ownership of the parcel.)

The only site plan issue discussed in any detail dealt with sidewalks. In response to a question from the Board whether the plan included any interior sidewalks, the applicant explained that based on the company’s experience with similar type developments, the residents did not want sidewalks.

Given the public input during the rezoning process, the Board postponed making a decision whether an early Public Informational Hearing  (PIH) on the site and subdivision plans will be needed and whether the Board can waive the requirement.  (Note: the PIH is unique to Yorktown and is not required by state law.) If not, both applications will be subject to a public hearings later in the review process.

The Board reiterated comments made at its April 21, 2025 meeting opposing the ban on Tier 2 BESS facilities and prohibiting solar farms as a main use in residential zones. In a 3-1 vote, the majority felt the Planning Board should be able to look at each application on a case by case basis.

Councilman Esposito, the Town Board liaison to the Planning Board, was critical of both decisions and asked Board members to have a more open mind. He said he had a list of other municipalities that have enacted bans, although it was not clear whether he was referring to BESS or solar farms.
