Toll Brothers. (See Planning Board August 11 2025.) In a continuation of the public hearing, most of the discussion dealt with the proposed lot line that would subdivide off the roughly 2.4 acre Field Home parcel from the rest of the development. The applicant said he was willing to provide more land for the Field Home site but strongly opposed any additional adjustment that would facilitate an access road bordering the two sites that was proposed in a conceptual plan for a boutique hotel being considered as an adaptive reuse of the Field Home. (Note: the architect preparing plans for the Field Home will be at the September 9 Town Board meeting.)
It was Toll Brothers’ position that any additional modification to the lot line would negatively impact its ability to market the planned townhouses that would be closest to the Field Home. Board members appeared to question Toll Brothers’ concern and suggested that there might be other ways to address the needs of both the developer and the town when considering future uses of the Field Home. Toll rejected the suggestion that it eliminate the “problem” townhouses.
There were no public comments at the hearing which was closed with a five day comment period left open.
AMS, 800 East Main Street. (See Planning Board August 11, 2025.) The Board opened and closed the hearing during which there were no public comments. The applicant advised the Board of a revision in the site plan that reflected the Board’s earlier comments, notably the inclusion of a mowed path from the buildings to the access driveway. In response the a memo from the Recreation Commission asking the Planning Board to impose a recreation fee on the developer, the applicant advised the Board that it has agreed to pay $225,000. (Note: While the Town Code currently does not require developers in RSP-2 zones to pay a recreation fee, NYS law gives the Planning Board the ability to impose a fee. The fee for multi family developers is typically $4,000 per unit, but less if there are on-site recreation amenities for the development’s residents.)
Planning Director Tegeder asked the applicant to also address the issue of a sidewalk on East Main Street from its driveway and to provide more information about tree mitigation.
Poggioreale Day care/Crompond Road. (See Planning Board August 11, 2025.) The Board approved the site plan after adding a condition to the approval resolution that restricts access to right turns in and out of the site.
RIC Battery Storage/Pervizi. (See Town Board August 12, 2025 and Planning Board August 11, 2025.) While in general in support of battery storage facilities, the Board voted to send a memo to the ZBA opposing the use variance given its concern that smoke from a fire would create safety hazards on the Taconic Parkway and Route 6. It was noted that the standard practice for handling battery storage facility fires was to let them burn out.
Envirogreen Associates, East Main Street. (See Planning Board August 11, 2025.) The applicant showed a revised plan for locating the HVAC on the ground adjacent to the rear of the building and behind a fence separating the equipment from the driveway. The Board will seek ABACA’s recommendation on the fence material and color before approving a site plan amendment.
Nantucket Sound/385 Kear Street. (See Town Board August 8, 2025 and May 20, 2025.) After apologizing to the Board, the building owner said he took full responsibility for the fact that that the HVAC equipment was not placed on the roof as required by the site plan. After the owner’s architect advised the Board that the plans the mechanical contractor submitted to the building department prior to getting the required permit showed the equipment on the side the building, the Board decided that it wanted to see the records of what had been submitted to the building department. In the meantime, the architect advised the Board that relocating the equipment to the roof would be a financial hardship to both move the equipment and also maintain it. He said that the existing equipment did not create a noise problem and that the units were adequately screened.
There was no discussion of the outstanding landscape issue due to the fact that the required invasive removal on the Mohansic Trailway can only be done at certain times of year.
Moundroukas/3665 Barger Street (See Planning Board March 24 and April 7, 2025.) In a formal application, the plan now calls for 13 parking instead of 17 as originally proposed. Planning Director Tegeder advised the Board that the plan fits the site, works and his department has no problems with it. A Public Informational Hearing will be scheduled in October. The applicant was advised to pursue discussions with the abutting funeral hone regarding a possible connection to the building’s parking lot.
